Almost all employees have the right for 5.6 weeks, that is, 28 days, paid leave per year (Statutory Leave or Annual Leave). In the total number of days off, the employer may include a national holiday (Bank Holiday).
What leave you have the right for. The majority of citizens who work five days a week must have 28 days of paid leave a year. This number is equivalent to the number of days worked per week (namely 5) multiplied by a coefficient of 5.6. However, you will not get more than 28 days off, even if you work six days a week. If you work less than five days a week, the leave, respectively, will be shorter. You can count the number of days, applying all the same coefficient 5.6 (let's say, if you work half-time three days a week, the leave will be 16.8 days per year). "Cumulative system". In addition, the employee has the right to accumulate leave days during the maternity leave or paternity leave, as well as during the sick leave. Or the employee can ask for a sick leave. The employee has the right to add national holidays to the leave, however employers are not obliged to pay them off.
The way it is paid off. The employee receives vacation pay for every week in the amount corresponding to the pay for the work week. The number of working hours is taken into account, as well as the rate at which a person works. The management must notify the employee in advance, at what time period he or she can have the leave. Somewhere the working year is the calendar year - from January 1st to December 31st, and somewhere - from April 1st to March 31st. If a person has come to work not from the beginning of a particular period, he will be entitled to a smaller number of vacation days, depending on the period worked.
The employer can refuse. The employee has the right to transfer part of his leave for the next year. If the leave is 28 days, then the person has the right to postpone up to 8 days for the following year. If a person could not use leave because of illness, then it can be postponed to 20 days to the next year. The employer has the right to refuse the employee on the leave in the desired period, but at the same time is obliged to give an opportunity to relax at another time. At the same time, the head of the company must together with the employee agree on the time of vacation in advance so that the work process does not suffer. The authorities can also ask the labor collective to go on vacation for the holidays, when there is no need to work.
Everything should be spelled out. The procedure for obtaining, calculating and paying for leave should be clearly stated in the employment contract so that the employer and employee know their rights and responsibilities. If the employee leaves the company, he is obliged to pay for the days due in the form of leave for the time worked, that is, to pay the unused vacation, if any.
